Division Of Retirement

Pensions and retirement accounts are often a significant asset in property division during divorce. While some financial accounts are straightforward, others can pose complex challenges. At The Law Offices of Eric J. Tatum, LLC, in Buford, Georgia, we are familiar with the complexities of dividing every kind of retirement account and employee benefit, including:

  • 401(k) savings plans
  • 403(b) annuity plans for teachers
  • Profit-sharing plans
  • 457 deferred compensation plans
  • Individual Retirement Accounts (IRAs)
  • Simplified Employee Pension plans (SEPs)
  • Simplified Employee Pension Individual Retirement Arrangement plans (SEP-IRAs)
  • Defined contribution plans
  • Defined benefit plans
  • Employee stock ownership plans (ESOPs)
  • Thrift and savings plans
  • Roth and educational IRAs
  • TIAA-CREF plans
  • Top-hat plans, SERPs, Rabbi trusts and other non-ERISA plans
  • Military retirement plans
  • Federal Employees Retirement System (FERS) plans
  • Railroad Retirement Plan Tier II benefits

The Art Of The QDRO

Retirement division plans are often drawn up using a court-required qualified domestic relations order, or QDRO, or its equivalent for military or non-ERISA plans. A QDRO orders retirement plan administrators to pay benefits to the plan member's ex. A properly designed QDRO will fairly divide marital benefits. But QDROs are famously difficult to get right. Lawyers unfamiliar with QDRO requirements have found themselves held liable for the error.
